Bronx lawyer who represented Fat Joe convicted of misdemeanor charges in 2013 drunken driving crash on Major Deegan Expressway

A Bronx defense lawyer who went on trial himself for a drunken driving episode that ended with a woman badly hurt was found not guilty of felony charges on Tuesday.

Philippe Dussek, 55, was convicted only of driving while impaired, a traffic violation, and reckless driving, a misdemeanor, for his role in a May 2013 crash that sent a 25-year-old woman to the hospital with broken bones, officials said.

The veteran attorney, who once represented the rapper Fat Joe, was acquitted of felony assault and vehicular assault charges after a roughly one-week non-jury trial.

According to court papers, Dussek had been swerving on the Major Deegan Expressway on his way home from a party when he smashed into another car.

A Ducati motorcycle riding behind him could not avoid the collision, prosecutors charged.

The motorcycle driver and passenger Nicole Rosario were both thrown to the ground - with Rosario suffering fractured shoulders, a broken foot and bruises all over her body.

Dussek faces up to 30 days in jail on the two state traffic law violations when he is sentenced on July 11.

His lawyers, Robert P Kelly and Bruce Kaye, wrote in a statement that "Mr. Dussek is a beloved attorney who feels terrible about the accident and is relieved that the court found that his actions only constituted vehicle and traffic law offenses."
